Eliza. Henmarsh to Ben. Franklin Exam’d. This Indenture made this first day of January in the year of Our Lord one thousand seven hundred and sixty three. Between Elizabeth Henmarsh of the City of Philadelphia in the Province of Pennsylvania Wido. on one part and Benjamin Franklin Esqr. of said City on the other part Witnesseth that the said Elizabeth Henmarsh for & in Consideration of one hundred pounds lawful Money of said Province well and truly paid before the Ensealing hereof by the said Benjamin Franklin the Receipt whereof the said Elizabeth Henmarsh hereby acknowledges and herself therewith fully satisfied & Contented & every part and [parecl] thereof. Doth acquit Exonerate and discharge the said Benjamin Franklin his Heirs Executors & administrators forever. Hath given granted Bargained Sold Conveyed and Confirmed & doth by these presents Give Grant Bargain Sell Convey & Confirm to the said Benjamin Franklin his Heirs and assigns a certain Lott or piece of land lying in the said City of Philadelphia Containing in Breadth North and South Sixteen feet & in length or depth Seventy three feet Bounded Eastward on the Sixth Street from Delaware River Southward and westward on lands — belonging to Isaac Jane & Northward on land granted by said Jane to James Davis which said Lot or piece of land was part of a lot or piece of land Seitwate in said City of Philadelphia containing in Breadth one hundred and thirty two feet on high street and in Length on Sixth Street three hundred and six feet which William Pen Esqr. Proprietary and Governour of said Province by Letter patent bearing date the Seventh day of the fourth Month (comonly calld. June) in anno Dom. 1684 for the Consideration therein mentioned Did grant & Confirm unto one Thomas Holme his Heirs and assigns forever & which being afterwards legally vested in the said Elizabeth Henmarsh and Others was by Indenture bearing date Novr. 15th Anno Dom 1742 granted & Released unto the said Isaac Jane his Heirs & assigns forever. As by the said Indentures appears referen’ce thereunto being had & the said demised Lot is the Same which the said Isaac Jane by his Deed of Bargain & sale dated Febry 24th Anno DOm 1743 granted & released unto the said Elizabeth Henmarsh Together with all the Ways Waters Water Courses paths passages Entries Profile Comodities advantages [Hereditaments] & [appurtenan] as whatsoever to the said Lot or piece of land & premises belonging or in anywise appertaining and the Reversions & Remainders thereof and all the Estate Right Title Interest property Claim and demand whatsoever both in Law & Equity of her the said Elizabeth Henmarsh of into & out of said premises and also true Copies of all Deeds Evidence & Writings touching or Conceiving the said Premises in her Custody or power such Copies to be taken only at the Request Charges & Costs of the said Benjamin Franklin his Heirs or assigns To Have and to Hold ye said Lot or piece of land and all other Premises hereby granted or intended to be granted with all the appurtenances to the same belonging to him the said Benjamin Franklin his Heirs and assigns forever to his and their proper use & Benefit forever & furthermore the said Elizabeth Henmarsh Covenants with the said Benjamin Franklin his Heirs & assigns the said demised premises with all the appurtenances thereto belonging to him the said Benjamin Franklin his heirs & assigns to Warrant secure and Defend against the Lawful Demands of any person or persons whatever claiming from by or under her and that the said demised premises are only Charged with a proportionable part of the yearly [Qu.nt?] rents hereafter to grow due for the whole Lot above said to the Chief Lord of the fee &c that she the said Elizabeth Henmarsh and her Heirs will make and duly Execute such further Conveyances & assurances of the premises at the Cost of the said Benjamin & his Heirs as he or they shall demand or his or their Council learned in the Law shall advise & Judge Necessary In Witness whereof the said Parties have hereto set their hands and Seals the day and year first above mentioned & Delivered these presents

Eli Henmarsh In presence of Fras. Hopkinson Chas. Thomson On the 23d day of February A.D. 1789 Before me Mathw Irwin Esqr. one of the Justices of the Court of Common Pleas personally appeared the Honorable Francis Hopkinson Esqr. who being sworn agreeable to Law doeth depose and say that the within name of Francis Hopkinson signed as a witness to this Indenture was wrote by this Deponent who also says he seen Elizabeth Henmarsh Sign Seal and acknowledge the said Indenture as her act and Deed sworn before me the Day and year above written Mathw.
